Terms of Service
These terms govern WRKZY accounts, customer operations workspaces, trials, plans, and subscriptions.
Service and account access
These terms form an agreement between AIRBRILS PRIVATE LIMITED, which operates WRKZY, and the business or organization using the service (the “Client”). They also apply to each person the Client authorizes to use its workspace.
WRKZY is offered for business and professional use, not for personal, family, or household use. A person creating an account for an organization represents that the organization is the Client and that the person has authority to bind it. Mandatory rights that cannot lawfully be excluded remain unaffected.
WRKZY is a customer operations CRM that connects WhatsApp and email conversations with customer context, campaigns, pipelines, quotes, automations, and owned follow-through.
WRKZY offers public account creation and workspace access, subject to email verification, account eligibility, product availability, and the plan limits shown during signup or checkout. A Client may also invite authorized teammates to its workspace.
By creating an account, accepting an invitation, starting a trial, purchasing a subscription, or using WRKZY, you confirm that you are authorized to act for the Client, are legally able to enter this agreement, are at least 18 years old or the age of legal majority where you live, and will use the service only for legitimate business purposes. If you do not agree to these terms, do not access or use WRKZY.
Accounts and client responsibilities
Workspace administration
- The Client must provide accurate account and workspace information and keep it current.
- Accounts are for named, authorized users. Credentials must not be shared, and access must be reviewed and revoked when responsibilities change.
- Workspace administrators control user roles, permissions, connected accounts, configurations, and customer data. The Client is responsible for activity performed through its workspace and accounts.
Lawful use
The Client is responsible for the contacts, messages, attachments, templates, campaigns, automations, CRM records, quotes, and other content used in its workspace. It must have all rights, notices, consents, permissions, and lawful bases required to process customer data and communicate with each recipient.
The Client must comply with applicable privacy, telecommunications, consumer-protection, anti-spam, marketing, and other laws, together with the terms and policies of every connected provider and the WRKZY Acceptable Use Policy.
Sensitive and regulated data
The service is not designed for payment-card numbers, authentication secrets, protected health information, biometric identifiers, precise location, children's data, criminal-offence data, or other regulated sensitive data unless WRKZY has expressly approved the use in writing and the parties have implemented all required contracts and safeguards.
Prohibited use
- Do not use WRKZY for spam, phishing, fraud, harassment, unlawful surveillance, deceptive activity, illegal content, or communications sent without required authority.
- Do not upload malware, interfere with the service, bypass safeguards or usage limits, probe another workspace, or attempt unauthorized access.
- Do not scrape, resell, reverse engineer, copy, or derive the service or its underlying components except where applicable law expressly permits it.
- Do not infringe, misappropriate, or violate another person’s intellectual-property, privacy, publicity, or other rights.
Connected channels and communications
Current supported communication channels include WhatsApp Business and email. WRKZY may support additional channels and providers as the service develops. Each connected account and third-party service remains governed by its provider’s own terms, policies, availability, and charges.
When the Client connects an account, it authorizes WRKZY to access, receive, store, and transmit the account data, messages, attachments, delivery events, and sending capabilities needed to provide the enabled workspace features. The Client confirms that it is authorized to grant that access.
The Client remains responsible for provider users and credentials, message content, recipients, templates, audiences, opt-in and opt-out handling, suppression lists, sending reputation, and provider-policy compliance. Provider outages, restrictions, reviews, or account actions may limit WRKZY features that depend on that provider.
Meta, WhatsApp, email services, and other connected providers are independent third parties and are not operated by WRKZY. Read our Meta and WhatsApp Data Use page for provider-review information.
AI-assisted features
When enabled, current AI features can prepare summaries, drafts, rewrites, recommendations, and CRM suggestions using selected, bounded workspace context. People decide whether and how to use the output.
AI output may be incomplete, inaccurate, or unsuitable for a particular situation. The Client and its users must review outputs, recipient details, messages, CRM changes, and configured automations before relying on them. WRKZY does not guarantee a particular AI result or business outcome.
A configured workflow may carry out its defined action, but current AI assistance does not independently execute autonomous, multi-step goals. References to agent-ready foundations or governed AI agents describe product direction, not a currently available autonomous service.
AI-assisted features may rely on third-party providers and are not a substitute for legal, financial, medical, security, or other professional advice. Processing is described in our Privacy Policy.
Data, ownership, and security
Client content
As between WRKZY and the Client, the Client retains its rights in the customer, workspace, and business content it provides to the service. The Client grants WRKZY only the limited permission reasonably needed to provide, secure, maintain, and support the service, follow the Client’s instructions, and comply with law. The Client confirms it has the rights required to grant that permission.
WRKZY does not sell Meta Platform Data, WhatsApp customer data, or Client workspace data. Our handling of personal data, retention, and verified requests is described in the Privacy Policy and Data Deletion process.
Where WRKZY processes client-controlled personal data, the Data Processing Addendum forms part of these terms. The current provider list is on the Subprocessors page.
WRKZY and feedback
WRKZY is a trademark of AIRMESH PRIVATE LIMITED. AIRBRILS PRIVATE LIMITED and its licensors retain all applicable rights in the service, software, interfaces, documentation, designs, and related technology. These terms grant only a limited, non-exclusive, non-transferable, revocable right to use the service during authorized access.
If the Client provides product feedback or suggestions, WRKZY may use them without restriction or compensation, provided that doing so does not identify the Client or disclose its confidential information without permission.
Confidentiality and security
Each party must protect non-public information received from the other with reasonable care and use it only for the relationship described by these terms. This obligation does not apply to information that is public without breach, independently developed, rightfully obtained without a duty of confidence, or required to be disclosed by law.
WRKZY uses safeguards designed to protect workspace and customer data, but no online service can guarantee absolute security. The Client must protect credentials, connected accounts, devices, and confidential customer information and report suspected unauthorized access promptly. Current controls are described on our Security page.
Availability and termination
Unless WRKZY agrees otherwise in writing, the service does not include a service-level commitment. Features, channels, limits, interfaces, and availability may change as the product, provider requirements, security needs, and applicable law develop. Material changes to a paid plan will be handled through the applicable plan, checkout, order form, or notice.
WRKZY may limit, suspend, or terminate access where reasonably necessary to address unlawful or prohibited use, a breach of these terms, security or operational risk, non-compliance with a connected-provider policy, a legal requirement, or harm to WRKZY, its users, providers, or others. Where practical and appropriate, WRKZY will provide notice and an opportunity to address the issue.
The Client may stop using WRKZY and request workspace closure through support. Ending access does not itself delete data. Retention and verified deletion requests follow the Privacy Policy and Data Deletion process. Before access ends, the Client should retrieve eligible information using available product tools or contact support about a verified request.
Plans, trials, and billing
Growth trial
Eligible new workspaces receive a 14-day trial of the Growth plan. No payment method is required to start the trial. The trial begins when WRKZY activates it for the workspace and is subject to the Growth plan capacities and acceptable-use limits shown during signup.
A trial does not become a paid subscription unless the Client selects a paid plan and authorizes payment. If no paid plan is activated by the end of the trial, write access and paid features may be limited or suspended according to the product experience shown to the Client.
Paid plans and renewal
WRKZY offers Starter and Growth subscriptions in supported currencies and monthly or annual billing intervals. The applicable pricing page and checkout identify the selected plan, currency, price, taxes, billing interval, capacities, and other commercial terms before the Client authorizes payment. Pricing shown at checkout controls if it differs from general marketing copy.
Paid subscriptions renew automatically for the selected billing interval until cancelled, unless the checkout or a written order states otherwise. The Client authorizes WRKZY and its billing providers to charge the applicable amount and taxes using the approved payment method. Failed or overdue payment may result in retry attempts, restricted features, suspension, or cancellation.
Billing providers, cancellation, and refunds
Chargebee provides subscription billing and payment-method management, and Razorpay is the configured payment gateway. Their own terms and privacy notices also apply to the payment services they provide.
The Client may cancel a subscription through the available account controls or by contacting support. Unless the applicable checkout, order, or law requires otherwise, cancellation takes effect at the end of the current paid billing period, amounts already charged are non-refundable, and unused time or capacity does not create a credit.
The complete digital delivery, cancellation, and refund rules are set out in our Service Delivery, Cancellation and Refunds Policy, which forms part of these terms.
Prices exclude applicable taxes unless expressly stated. Unless included in the selected plan or written order, fees charged by Meta, messaging providers, email providers, telecommunications carriers, or other connected services remain the Client's responsibility.
Disclaimers and legal terms
Disclaimers
To the extent permitted by law, WRKZY and its features are provided on an “as is” and “as available” basis. WRKZY does not warrant uninterrupted or error-free operation, preservation of every item of data, compatibility with every provider, or a particular commercial, messaging, automation, or AI outcome. Rights and warranties that cannot lawfully be excluded remain unaffected.
Limitation of liability
To the extent permitted by applicable law, WRKZY and AIRBRILS PRIVATE LIMITED will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, business opportunity, or data arising from use of or inability to use the service. Nothing in these terms excludes or limits liability where applicable law does not permit it.
To the maximum extent permitted by law, the aggregate liability of WRKZY and AIRBRILS PRIVATE LIMITED arising out of or relating to the service or these terms will not exceed the fees paid or payable by the Client for WRKZY during the 12 months before the event giving rise to the claim. For a free-only service, the cap is USD 100. This cap does not apply where liability cannot lawfully be limited.
Third-party claims
To the extent permitted by law, the Client will defend and indemnify WRKZY and AIRBRILS PRIVATE LIMITED against third-party claims, losses, and reasonable costs arising from Client content, unlawful messaging, infringement of third-party rights, misuse of the service, or the Client’s material breach of these terms or connected-provider policies.
Governing law and disputes
These terms are governed by the laws of India. Subject to mandatory legal requirements that may apply, courts in New Delhi, India will have jurisdiction over disputes relating to these terms or the service.
Export controls and sanctions
The Client must not use, export, re-export, or make WRKZY available in violation of applicable trade controls, sanctions, or embargoes. The Client represents that it and its authorized users are not prohibited from receiving the service under laws applicable to the transaction.
Force majeure
Neither party is liable for delay or failure caused by events beyond its reasonable control, including natural disasters, war, civil disorder, labor disruption, internet or utility failure, provider outage, cyberattack not caused by a breach of reasonable safeguards, government action, or changes in law. Payment obligations already due are not excused.
Changes and general terms
WRKZY may update these terms as the service, provider requirements, security practices, or applicable law changes. The revised terms will be posted here with an updated date, and additional notice will be provided when required. Where required by law, materially adverse changes to paid-service terms will take effect only after the stated notice period, and the Client may cancel before they take effect. Continued use after the effective date constitutes acceptance to the extent permitted by law.
These terms, the Acceptable Use Policy, applicable service and refund terms, the Data Processing Addendum, and any order form accepted by both parties form the agreement for the service. If they conflict, a signed order form controls its commercial subject, the DPA controls personal-data processing, and these terms control other matters, unless a document expressly states otherwise. If a provision is unenforceable, the remaining provisions continue in effect. A delay in enforcement is not a waiver. The Client may not assign these terms without WRKZY’s written consent; WRKZY may assign them to an affiliate or successor in connection with a reorganization, financing, merger, or sale of the relevant business or assets.
Notices
WRKZY may send operational or legal notices to the email address associated with the Client's account, through the service, or by posting where law permits. Formal legal notices to WRKZY must be sent to support@wrkzy.com and the registered address on the Contact page. A notice is effective when received, subject to mandatory law.
